PUWER stands for the Provision and Use of Work Equipment Regulations, and places legal obligations on those responsible for work equipment.

It ensures the work equipment is safe to use, correctly maintained and inspected by trained & competent personnel and operated by personnel who have received adequate training.

Yes, PUWER applies wherever the Health and Safety at Work Act applies. It is not an optional extra or a nice to have. 

The Approved Code of Practice and guidance is aimed at employers, duty holders and anyone who has responsibility for the safe use of work equipment.

 The PUWER ACOP has been approved by the Health and Safety Executive, with the consent of the Secretary of State. It gives practical advice on how to comply with the law. If you follow the advice you will be doing enough to comply with the law in respect of those specific matters on which the PUWER ACOP gives advice.

However, the PUWER ACOP has a special legal status. If you are prosecuted for breach of health and safety law, and it is proved that you did not follow the relevant provisions of the PUWER ACOP, you will need to show that you have complied with the law in some other way or a Court will find you at fault.

PUWER applied to work equipment, however LOLER (Lifting Operations Lifting Equipment Regulations) applies in addition to PUWER where lifting takes place. LOLER applies to devices such as hoists and lifting accessories. The LOLER ACOP can be downloaded from the HSE website for free.

The Approved Code of Practice and guidance is for those that work with any lifting equipment provided at work or for the use of people at work, those who employ such people, those that represent them and those who act as a competent person in the examination of lifting equipment.

Yes, will provide a 3-day approved PUWER assessor training course that provide potential assessors with the core information needed to carryout PUWER assessments.

PUWER assessments must be carried out by a competent persons, who possesses sufficient knowledge, training and experience of the equipment being inspected, its safety standards and installation.
